Terms of Service & End User Licence Agreement

Last updated: October 2026 · Governed by the laws of the Republic of South Africa

1. Agreement

These Terms of Service ("Terms") form a binding agreement between you (the agency, principal, or agent registering a workspace) and PropSource ("we", "us"). By creating an account or using the platform you confirm that you have read, understood and accepted these Terms and our POPIA Privacy Policy.

2. Licence, not sale

PropSource grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the platform for your agency's internal property sourcing operations. The platform is licensed, not sold. No ownership of any part of the software transfers to you.

3. Intellectual property

PropSource, including its source code, interface design, branding, and proprietary mechanisms — such as the free-placement Listing Pack document mapper, the duplicate-detection engine, and the Pocket Network model — is protected under the Copyright Act 98 of 1978 (as amended) and international treaty. All rights are reserved.

You may not:

  • copy, reproduce, or create derivative works of the platform or its interface;
  • reverse engineer, decompile, or attempt to extract the source code or algorithms;
  • scrape, harvest, or bulk-export data for use in a competing product or service;
  • use the platform to build, benchmark, or train a competing service.

Suggestions, feedback, or feature ideas you share with us may be used freely by PropSource and become part of the platform's intellectual property, without compensation or attribution.

4. Your data remains yours

Your agency owns 100% of the data you capture: property records, owner details, notes, documents, and commission figures. We claim no ownership over your data and do not sell, share, or mine it. On account closure you may request an export, after which data is securely purged per our Privacy Policy.

5. Cross-border processing

Certain service providers used by PropSource may process or store information outside South Africa. Where personal information is transferred across borders, PropSource takes reasonable steps to ensure that appropriate contractual and technical safeguards are in place consistent with POPIA.

6. Security incidents and data breaches

Where required by applicable law, PropSource will notify affected agencies of material security incidents involving their information and will reasonably assist the agency in meeting its legal obligations.

7. Acceptable use

You agree not to:

  • use the platform for unlawful harassment, spam, or unsolicited marketing contrary to POPIA;
  • share workspace access with persons outside your agency or misrepresent your identity;
  • misuse Pocket Network information, property information or other agency data made available through the platform;
  • attempt to breach workspace isolation or access another agency's data.

We may suspend or terminate access for material breach of these Terms.

8. Documents, mandates and compliance

PropSource is an administrative document-generation tool. Listing Packs, mandates, and FICA questionnaires are generated from templates and data supplied by your agency. Legal validity, PPRA compliance, FICA adequacy, and the accuracy of executed documents remain solely the responsibility of your agency and its registered agents. We accept no liability for documents generated through the platform.

9. Subscriptions and billing

Paid workspaces are billed for the period and in the currency shown at purchase. New workspaces receive a 14-day free trial; pilot arrangements are described at sign-up. Cancelling stops future renewals while retaining access through the current paid period. Fees are non-refundable for unused time, except for confirmed billing errors, duplicate charges or where required by law. See our Refund & Cancellation Policy for cancellation instructions and full refund terms. We may change pricing for new subscriptions; price-locked plans retain their locked rate for as long as the subscription remains active and in good standing.

Certain workspaces may receive Pilot Access, Partner Access, trial access or promotional access. These arrangements may be modified, withdrawn or converted into standard subscriptions with reasonable notice.

10. Availability and liability

We aim for high availability but do not warrant uninterrupted service. To the maximum extent permitted by law, PropSource is not liable for indirect, consequential, or incidental damages — including lost commissions or lost data — arising from use of the platform. Our aggregate liability is limited to the fees you paid in the twelve months preceding the claim.

11. Governing law

These Terms are governed by the laws of the Republic of South Africa. The parties consent to the exclusive jurisdiction of the High Court of South Africa for any dispute arising from these Terms.

12. Contact

Questions about these Terms can be sent to us via the contact details published on propsource.app.

These terms are provided for informational purposes and may be updated periodically as the platform evolves.
